Back then, I thought e-cigarette packaging was just about making products look sleek and on-trend for vape shop shelves. Today, every order we fill starts with a deep dive into the latest Health Canada rules—because getting this wrong isn’t just a missed sale, it’s a legal headache for both my team and the vape brands we partner with. Let me walk you through what I’ve learned, the hoops we jump through, and why these regulations matter for everyone from small vape operators to the suppliers who craft their packaging. Electronic Cigarette Packaging

Canada’s e-cigarette packaging rules didn’t pop up out of nowhere. They’re rooted in a decades-long focus on public health, especially around youth access to nicotine products. The big piece of legislation that set everything in motion is the Tobacco and Vaping Products Act (TVPA), which was updated back in 2018 to include vaping products. Before that, e-cigarettes were mostly unregulated in Canada, with packaging that often looked like USB drives, candy containers, or even luxury perfume bottles—pretty much designed to appeal to teens. Health Canada noticed that and pushed hard to change that. The TVPA, and the regulations that followed (you’ll hear these called the Vaping Products Regulations, or VPRs), apply to every part of an e-cigarette, from the nicotine cartridge to the disposable vape, and that includes the packaging that holds them.

Let’s break down the non-negotiables that every packaging design we work on has to meet. First, there’s the plain packaging requirement. Unlike cigarette packaging, which had been plain for years, Canada extended plain packaging rules to vaping products in 2020. What does plain packaging mean here? No more bright neon colors, no cartoon characters, no imagery that makes vaping look cool or fun. The packaging has to be a standard dark brown or black, with only the brand name and product name in a specific font and size that’s approved. Even the texture can’t be shiny or glossy— it has to be matte, to avoid being eye-catching. That was a huge shift for my business at first, because for years we’d been making those sleek, custom boxes that customers loved. Now, every box has to be neutral, no frills, no attention-grabbing details.

Next, the warning labels. These aren’t the little sticky labels you might see on a prescription bottle. Health Canada requires large, graphic warning labels that cover 75% of the front and back of the packaging. The images aren’t soft, either—think blackened lungs, diseased teeth, a baby with a pacifier that has “nicotine” written on it, to show the risk of fetal exposure. The text on these labels has to be in both English and French, and the wording is strictly regulated too. For example, one common label says “Vaping is not safe. It exposes you to toxic chemicals that can cause lung disease, addiction and other serious health problems.” My design team has to memorize every required label and their exact placement, because getting that wrong means the entire order gets sent back. We’ve had to adjust our workflow to include a second review step specifically for warning labels—no cutting corners here.

Then there’s the issue of child-resistant packaging. I can’t tell you how many times a customer has asked, “Can we skip the child-resistant seals to make the box look nicer?” And every time, the answer is a firm no. Under the VPRs, all e-cigarette packaging that holds nicotine has to be child-resistant. That means the packaging has a closure that a typical four-year-old can’t open, but an adult can easily access. We work with specialized manufacturers that make these closures, and we have to test every batch we receive to make sure they meet Health Canada’s standards. We also have to make sure the packaging is tamper-evident—so you can tell if someone has opened the product before it reaches the customer. That’s another layer of work, but it’s non-negotiable for keeping kids safe and staying compliant.

Wait, there’s more. In 2023, Health Canada added even more rules around packaging for disposable vapes, which are super popular right now. Disposables are small, easy to toss in a backpack, and their packaging has to be labeled with the exact amount of nicotine in the device, a list of ingredients, and instructions for safe disposal. Because disposables are often single-use, there’s a big push to reduce waste, so the packaging has to be made of recyclable materials too. We’ve had to switch some of our packaging from plastic to recycled cardboard and paper, which was a learning curve—some of those older child-resistant plastic seals don’t work as well with recycled materials, so we had to partner with new suppliers to find solutions.

I’ve seen first-hand what happens when a brand doesn’t follow these rules. A few years ago, a small vape shop in Vancouver ordered 500 boxes of disposable vapes from a supplier that didn’t do their research. The boxes had a bright blue logo, which violated plain packaging rules, and the warning labels were only in English, no French. Health Canada did a random inspection and seized the entire shipment. The shop lost thousands of dollars, and the supplier got a fine. That’s why we make compliance the first question we ask every new customer: “Have you confirmed your packaging meets all Health Canada requirements?” If they say no, we don’t take the order—even if it means losing money in the short term. Our reputation is built on being reliable, and that means not cutting corners on the rules that protect Canadians.

Of course, regulations evolve, and that means we have to stay on top of changes every year. Last year, Health Canada proposed new rules that would ban certain flavors in vaping products, which would impact packaging because flavor names can’t be used anymore. We’ve already started adjusting our design templates to leave space for generic product names instead of “Mint Crush” or “Strawberry Delight.” We also subscribe to Health Canada’s email alerts, attend industry webinars, and even have a part-time compliance officer on our team whose only job is to track changes. It’s extra work, but it’s worth it to make sure our customers don’t get caught off guard.

I’ve also had to educate our customers on these rules, because many are small operators who don’t have a legal team. Last month, a customer from Toronto came to us asking for packaging for a new line of CBD vapes. They didn’t realize that CBD vaping products have different rules than nicotine ones. CBD packaging doesn’t need the same graphic warning labels, but it does still need to be child-resistant and have proper ingredient labeling. We walked them through every step, revised their design, and by the time they placed the order, they were way more confident that they’d be compliant. That’s the kind of partnership we strive for—we’re not just a supplier, we’re a resource.

Another thing I’ve learned: Canadian packaging rules are some of the strictest in the world. When I started, I looked at regulations in the US and EU, and Canada’s are far more detailed. That’s not a bad thing, even if it’s more work for us. I think about the teen who might not be able to open a child-resistant disposable vape, or the parent who sees a graphic warning label and thinks twice before letting their kid pick up a vape. These rules aren’t just red tape—they’re designed to keep people safe.

Now, if you’re a vape brand operator in Canada, you might be reading this and wondering how to make sure your packaging is compliant. Or maybe you’re new to the market and not sure where to start. That’s where we come in.
